If You're Arrested...

Knowing what to do if you’re arrested is crucial to insuring a favorable outcome. What you do and say when you’re arrested and the immediate time after your arrest
can be the difference in walking away with no conviction or being sentenced to years in prison. Take your rights seriously, and use them to your advantage.

Don't Do This

consent to a search of your vehicle, person, or residence (including your apartment, room, hotel room, or house)
agree to an interview or questioning about your case
speak about your case to anyone while in custody
plead guilty at your first appearance if arrested for a misdemeanor
discuss your case while on the phone with family, friends, or anyone other than your attorney
admit to anything

Do This

invoke your Fifth Amendment right to remain silent (“I am invoking my right to remain silent”)
ask to contact an attorney immediately (“I am invoking my right to speak with an attorney”)
immediately hire, or have family or friends hire, an experienced, aggressive and knowledgeable criminal defense attorney
